Is Product Placement Against The Law?


E.T. and Reese's Pieces. Tom Cruise and Ray-Ban sunglasses. James Bond and the BMW Z3 convertible. Product placement has been an effective advertising strategy for years, with seemingly little downside. It's a very cost effective way to promote a brand in a positive context, but is it legal?

This summer, NBC announced a deal with Avon to promote a new cosmetic line by integrating it into the plot of its new soap opera, "Passions." NBC also made a deal with the Mandalay Bay Casino in Las Vegas to use their property as the backdrop for the mythical casino "Montecino" in their new show "Casino." And the only beer you'll see (and you'll see it often) on NBC's new reality show, "The Restaurant" is Coors, the result of an exclusive agreement between the two companies. Read More

Hill Country Ride for AIDS

Following up on two first-place national Club Achievement awards, the Public Service Committee is helping Hill Country Ride for AIDS grow with fresh media strategies and new collateral. Co-chairs Valerie Davis, Tuerff-Davis Enviromedia and past president Scott Van Osdol assembled a creative powerhouse that includes designer Sean Carnegie, Headgear Creative, copywriter Jeff Neely, agency principals Larry McIntosh, The MAD House, and Martha Cary Sadler, MCS Advertising. Supporting them are Enviromedia staff John Burger, Pam Udall, Jill Burpo, Nourzads AD Megan Berryman, and Past President Liam Kernell, Liaison Resources. Last year 215 riders and 150 volunteers raised over $300,000 to assist local AIDS services. Ad Fed members and friends contributed $1400 to Van Osdol's 140 mile ride.

Helmet Heads
The Ad Fed Veloci-Peddlers train for the Hill Country Ride every Saturday morning, 8 AM, at the Veloway on South Mopac. Our motto is "Our Campaign's Got Great Legs!" (on riding jerseys soon thanks to James Walker, TKO). Riders of all skill levels are welcome. Contact Coach Scott at sv@constant.com.

Art from the Streets
Art from the Streets raised over $100,000 for homeless artists in the last two years, thanks to Austin Ad Fed Past President Eileen Keller, ideality.com, who leads the marketing blitz assisted by photographer Scott Van Osdol. This year GSD&M producer Tim Sabo, and ADs Christopher Colton and Travis Wade helped produce billboards, display ads and a TV PSA. April Jones produced the print and billboard.

Assault on Alcohol Industry Continues

Anti-alcohol advocates are pressuring Congress to limit advertising for and increase the "sin" tax on alcoholic beverages. A recent survey released by the Center on Alcohol Marketing and Youth stated that parents blame advertising for underage consumption. The survey claims that 81 % of parents do not believe advertising alcohol is a "legitimate" business practice. a majority of them find several types of marketing, specifically Web sites that include special features like games and television advertising, "very troubling."

AARP Asks Medicare Conferees to Reconsider D
irect To Consumer
AARP executive director & CEO William Novelli wrote to members of Congress conferring on the Medicare prescription drug benefit legislation and asked members to consider tighter controls on DTC advertising. The letter lists items the group would like included or amended before endorsing legislation. Novelli asks for stronger FDA oversight of DTC ads andclaims the ads cause unnecessary increase in drug demand FDA oversight of DTC ads is tough as ia to make prescription drug ads the most heavily regulated of all advertisements.

TAX = BAD TAX
The Texas legislature is expected to convene in a special session in late 2003 or early 2004 to consider school financing. Insiders expect this to include a look at the state's sources of tax revenue, especially sales tax. We expect the legislature to consider eliminating the current sales tax exemptions on most advertising services. It is important that our industry be familiar with the many reasons why it's a bad idea. To check out our talking points and other resources, click here.

The Texas Advertising Group (TAG) has recently re-vamped their website. Check it out.

TAG is the college chapter of the American Advertising Federation (AAF). With a mission to help students make contacts in advertising and marketing, to help them build a solid foundation, and prepare them for careers, TAG knows the importance of networking and aims to help students make contacts. And they know where to get cheap beer.

TAG competes at this year's Houston Ad-Fed competition on Oct. 31 - Nov. 1
